1. Acceptance of Terms

By accessing or using BookEngine (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

These terms apply to all users of the Service, including business owners who create accounts and their customers who make bookings.

2. Description of Service

BookEngine is a booking and scheduling platform that enables service businesses to:

  • Accept online bookings from customers
  • Manage services, availability, and scheduling
  • Process payments through Stripe
  • Send automated email notifications
  • Sync with Google Calendar
  • Embed booking widgets on external websites

3. Account Registration

To use the Service as a business owner, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the security of your account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Keeping your contact information up to date

You must be at least 18 years old and have the legal authority to enter into these terms on behalf of your business.

4. Business Owner Responsibilities

As a business owner using BookEngine, you agree to:

  • Provide accurate information about your services and pricing
  • Honor bookings made through the platform
  • Comply with all applicable laws and regulations
  • Handle customer data in accordance with data protection laws (including UK GDPR)
  • Not use the Service for any illegal or unauthorized purpose
  • Respond to customer inquiries and complaints in a timely manner

4.1 Data Protection

You are the data controller for customer information collected through your booking pages. You must:

  • Have a lawful basis for collecting customer data
  • Only collect data that is necessary for providing your services
  • Inform customers how their data will be used
  • Respond to customer data access and deletion requests

5. Customer Responsibilities

As a customer making bookings through BookEngine, you agree to:

  • Provide accurate contact information
  • Attend booked appointments or cancel in accordance with the business's policy
  • Pay any required deposits or fees
  • Treat business owners and their staff with respect

6. Payments

6.1 Payment Processing

Payments are processed through Stripe. By using payment features, you also agree to Stripe's Terms of Service.

6.2 Business Owner Payments

Business owners receive payments directly to their Stripe Connect account. BookEngine may charge a platform fee on transactions as disclosed in your account settings.

6.3 Refunds and Disputes

Refund policies are set by individual businesses. Customers should contact the business directly regarding refunds. We may assist in resolving disputes but are not responsible for refund decisions.

7. Third-Party Integrations

7.1 Google Calendar

If you connect Google Calendar, you authorize us to access your calendar data as described in our Privacy Policy. Your use of Google services is also subject to Google's Terms of Service.

7.2 Embedded Widgets

You may embed BookEngine booking widgets on third-party websites. You are responsible for ensuring you have the right to embed content on those websites.

8. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware or malicious code
  • Attempt to gain unauthorized access to our systems
  • Interfere with the Service's operation
  • Scrape or harvest data from the Service
  • Send spam or unsolicited communications
  • Engage in fraudulent activities
  • Offer illegal services or products

9. Intellectual Property

The Service, including its design, features, and content, is owned by BookEngine and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

You retain ownership of content you upload (business information, logos, etc.) but grant us a license to use it to provide the Service.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may:

  • Perform maintenance with or without notice
  • Modify or discontinue features
  • Suspend accounts that violate these terms

11. Limitation of Liability

To the maximum extent permitted by law, BookEngine shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, or data
  • Business interruption
  • Actions or omissions of third parties (businesses, customers, payment processors)
  • Service interruptions or errors

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless BookEngine from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these terms
  • Your violation of any third-party rights
  • Content you upload or transmit

13. Termination

You may close your account at any time. We may suspend or terminate your account if you violate these terms or for any other reason with notice.

Upon termination, your right to use the Service ceases. Data retention after termination is governed by our Privacy Policy.

14. Dispute Resolution

We encourage you to contact us first to resolve any disputes. These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

We may modify these terms at any time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.
